Terms & Conditions for Messy Play Kids
General Terms
- Parents or guardians bear sole responsibility for the well-being and safety of their child or children while attending our sessions. Under no circumstances will parents or guardians be permitted to leave their child or children unattended in the play area or facility during a session.
- Messy Play Kids will not be held accountable for any injuries sustained by parents, guardians, guests, or children while using equipment or coming into contact with materials or food items during the play session that may cause harm or illness.
- Messy Play Kids will not be responsible for any loss or damage to personal belongings throughout the duration of a play session.
- It is the responsibility of parents or guardians to inform Messy Play Kids of any allergies their child or children may have before attending a session. Additionally, parents or guardians must ensure that their child or children do not interact with any edible or non-edible items that could potentially cause harm, illness, accidents, or allergic reactions.
- Messy Play Kids will not be liable for any marks, stains, or damage to clothing. We recommend that all parents, guardians, and children wear appropriate clothing for our play sessions.
- We advise against the consumption of any materials or food items provided by Messy Play Kids, even if they are non-toxic and hypoallergenic. Some products, despite being edible, may pose a risk of illness, harm, or allergic reactions.
- Parents or guardians are responsible for supervising their child or children when playing with edible and non-edible items, such as toys, as they could potentially present a choking hazard. Messy Play Kids will not be held responsible for any illness, accidents, deaths, or allergic reactions resulting directly from items provided during a play session.
Sessions Refunds & Cancellations:
- Unfortunately, we do not offer refunds in the event of non-attendance or canceled sessions. It is the responsibility of parents or guardians to inform Messy Play Kids if they are unable to attend a session. If a parent or guardian cannot attend the remaining sessions, these sessions may be transferred to an alternative individual, such as a family member or friend.
- A full upfront payment for the session is required before the session date. Parents or guardians who have not booked or paid for their child or children’s play session in advance will not be allowed to enter the play area.
- In the event of session cancellations by Messy Play Kids due to staff illness, low attendance, unforeseen circumstances, or COVID-19, you will be notified in advance, and arrangements will be made for the session to be rescheduled for another available date.
- Please note that we use an outdoor venue and sessions are weather dependent. We will always monitor the forecast as best as possible and get in touch with you in advance to reschedule your session in the event of bad weather.
Waiver and Release from Liability:
- I/We hereby waive any and all claims that I/We may have now or in the future against Messy Play Kids, its officers, trustees, agents, and employees, for any loss, damage, expense, or personal injury, including death, resulting from any cause whatsoever, including breach of contract, negligence, or lack of care.
- I/We agree to indemnify and hold Messy Play Kids harmless from any liability for property damage, loss, or injury, including death, to any third party.
- These terms and conditions shall be binding on my/our heirs, next of kin, executors, administrators, assignees, and representatives.
- I/We agree that all obligations arising from this document shall be governed and exercised within the jurisdiction of the session.
- In the event of any litigation, exclusive jurisdiction will be within the area of the session.
